The Georgia Supreme Court on Friday ordered that Genarlow Wilson be released from prison, ruling 4-3 that his sentence for a teen sex conviction was cruel and unusual punishment. Wilson, 21, was convicted in 2005 of having oral sex with a consenting 15-year-old girl when he was 17. He has served more than two years in prison.
It’s a shame that over two years of his life went down the drain just from a little fellatio fun on New Year’s Eve.

Yeah, but he fought the good fight for a good cause. Because of Genarlow’s struggle, that ridiculous law was struck down. He’s a civil rights hero in my eyes.

That is so trifling of the Georgia Court System to have him go to jail for that petty conviction, even more so that the court obviously was still split w/ a 4-3 verdict. I’m so glad he didn’t take a plea deal.
A few words of advice Genarlow; stay away from MySpace and any award show where there is more security than celebrities.

Justice came late, but a young man can get back on the road to getting his life back. I live in Atlanta, am embarrassed by my state’s legislative and judiciary branches. I think that Genarlow should sue!! As usual, Georgia remains an embarrassment to all.

Now while I agree that the 10 year sentence was severe I support Statutory Rape laws very much so… Hopefully he’s learned a lesson. Maybe he needs to stop sticking his dyck down 15 year olds girls throats..

He should sue! He was a good student and sports player with scholarships on the table. Trust that those opportunities are gone. He can still go to school, but those things that he worked hard for were taken away because of this injustice. We aren’t going to even talk about the mess he had to deal with in jail. No amount of money and / or therapy is going to fix the damage that was done.
I do agree that statutory rape statutes should remain, but both of them were minors at the time of the offense. Where is the statutory rape in this case? Now, R. Kelly and all the minors that he had sex with, that is statutory rape. He hasn’t served a day! He is going on tour and people are paying to see him. Where is the justice in that?

Some of these teenage girls need to be punished as well…..they too hot in crotch these days. She should’ve marinated in a juevenille detention for 2 years just like ol’ boy did.

I think that in theory the law makes sense….in the sense that it was designed to prevent underage children from participating in sexual acts (consenting or non consenting) with adults…however when you consider consensual sex between a 15 and 17 year old…come on …the fact that he was convicted and sentenced to jail like he was some 40 year old man with a 15 year old girl was absolutely ridiculous….my hope is that he will learn how to function outside of jail after this travesty…my understanding is that he was a fairly good kid…athlete…and now he has to start all over as an adult and try and figure out how he fits into the outside world….I wish him much success

I’m glad he’s OUT of jail, but he never should have been IN a hotel room from the beginning!
Prom night, he and his friends were in a hotel room prom with several girls, including the 15 year old. They taped themselves having sex and, of course, showed the tape to other people.
I lay the blame squarely on his parents. We’ve got to learn to parent our children BEFORE they find themselves in trouble!
I think another factor for the sentencing is that the fellatio was video taped and because the girl was underage the court considered the tape kiddie porn, so that was also part of it.
I find it ridiculous that he was in jail for 2 years for getting some head. I realize the girl was 15, but he didn’t rape her and being that he was 17 at the time doesn’t matter to me. This situation to me has nothing to do with statutory rape, it has to do with racism…period. I’m glad that he is out of jail though finally. And hopefully that young white girl will keep her mouth off the brothers’

The girl was actually black, her mom was interviewed and stated that the DA forced the charges in the first place similar to Jena 6 DA, he threatened the mom with child protection charges against her if she did not file criminal charges against him. The mother of the “victim” and the “victim” herself never wanted this case.

I wish some of you would read up on Genarlow’s story, because it is obvious many of you know nothing about it. As much as I read on the case I still don’t know the race of the 15 and 17-year old girls. How do you know she is white? Secondly, the 15 year old gave head around the room to mulitple boys. She literally walked up to them and pulled their stuff out and put it in her mouth. This was not statutory rape unless you are charging the girl. The party was wrong from a parents standpoint, but it definately was not criminal.
This is the best news I’ve heard all week. I am so happy for him and his family. Like some of the others have said, he still has an opportunity to go to school and move on with his life. I wish him well!

I have never read that in a news story on this case. Some bloggers say the girls were black others say they were white. I chose to believe that none of you really knows their race and its not important anyway. Whatever they were they had horribly low self-esteem. I hope that situation has improved.

I saw the girl with her mohter on the news, along with snippets of the video that was made the kids (damn camcorders)
Court TV did a live interview with the mom her face was blurred on the screen, but you could see her hands and arm, she was black.

Everybody has done something stupid when they were a teenager. Damn….He was just 17 and the girl was 15 and they probably went to the same school or were in high school at the same time. Now this girl is scandalous they need to probe her butt to find out when did these oral fixations start. Report: Mother of minor in teen sex case changed statement after visit from prosecutors
ATLANTA (AP) — The mother of a then-15-year-old girl in a highly publicized teen sex case told a newspaper that the boy involved should not have been criminally charged, but she changed her statement a day later after a visit from prosecutors, the newspaper said Thursday.
Lawyer B.J. Bernstein, who represents the young man, Genarlow Wilson, called the prosecution’s visit “pure intimidation.”
She said the mother’s interview had made clear that the New Year’s Eve party encounter between Wilson, then 17, and the 15-year-old girl “was definitely a consensual act.”
Wilson was convicted of aggravated child molestation and — based on a law that has since been changed — was sentenced to a mandatory 10 years in prison. That sentence drew widespread criticism as grossly disproportionate to the crime, and a judge on Monday, calling it a “grave miscarriage of justice,” ordered Wilson released. But Wilson, now 21, is still behind bars because the state attorney general is appealing the decision.
In an interview Tuesday, the girl’s mother told The Atlanta Journal-Constitution that her daughter had told her the videotaped sex acts were consensual. The mother also said she regretted that she didn’t ask prosecutors not to charge Wilson and four other boys at the party.”She did not want any of this to happen,” the mother said. “I felt like Douglas County was trying to make an example out of these boys.”
The day after that interview, the mother spoke to the Journal-Constitution again, saying she was worried that she might be misquoted. She said Douglas County Assistant District Attorney Eddie Barker was at her home with an audio recorder to discuss what she had said.
Douglas County District Attorney David McDade later disclosed that his office had taped the woman’s second conversation, the newspaper reported.
“We were actually at her home when you were talking to her (Wednesday) morning,” McDade said, according to the paper. “We were recording the conversation and so we have a tape of her telling you that you were twisting her words.”
Bernstein said Thursday, “It was something that almost reminds us of what happens in a Communist country, that when you speak out about something to the media, you get a visit from the government.”
Messages left Thursday with McDade’s office seeking further comment were not immediately returned.
Barker, the assistant district attorney, told the paper: “Never once did she ever ask us not to prosecute this case.”
In the initial interview on Tuesday, the mother told the newspaper that before Wilson’s trial, Barker had told her that if she didn’t assist the prosecution, she could face legal trouble for “neglect” as a parent. Barker denied that assertion, the newspaper said.
On Wednesday, the mother said that Barker had not been “threatening” her but rather giving her advice.
The AP is not naming the mother to protect the identity of the girl, who is considered a sex crime victim.
The girl, now 18, declined a request for an interview. The mother said the young woman had since joined the military to pursue a career in nursing.
“She is trying to put it all behind her,” the mother said. “She does not want to come back to Douglasville because it is still a touchy subject. She still deals with it every day.”
I just skimmed through this, so maybe i’m missing something, but if he was 17, how was this statutory rape? Isn’t 17 still considered the age of a minor?

The DA decided to charge him as an adult instead of a juvenile like the other boys involved. The way the case went, the families of the other boys took the lower charge to get it over with, but he with this family, decided to fight charges period. After the mom said she didnt want to charge this, the DA went ahead anyway, then upped the charge to an adult charge effectively putting it to him and his family.
The DA knew ultimately he could keep him there that long because the law was on the books, then the law changed, and he had to back down.
The only thing he can do to hurt him now is to demand that he register as a sex offender for the rest of his life, which I for one would not put past him.

No the law states 18 and older, but the DA bent the law and charged him as an adult, thats where the “cruel and unusual punishment ruling” came from.
In other cases in the same county, they were handled as juveniles, given 6 mos probation, and no sex offender registration.
That’s where the fight between the DA and the family began.

That’s what the hell I’m saying. How is it that two minors both want to do something sexual but only the male is charged with doing something wrong? DAMN THIS IS FUCKED UP. Georgia Supreme Ct. is basically saying that he was indeed a minor and for the DA to charge him as an adult when the law clearly states the penalty is for an “adult” (18 years and over) was on its face cruel and unusual, and that the charge never should have gone forward like this, the original sentencing judge could have ordered the case refiled correctly, but did not due to media exposure, and other factors.

Is it me or does it seem like these white prosecutors around America especially the south are trying to by pass the laws of this country in an attempt to throw decent young black men in jail. Things as of lately that have been going on like this ordeal and Jena 6 just makes me wonder. I think we as a people better start getting educated on the laws of the land. If any black attorneys read this post please start trying to have some type of seminars or meetings with black youths in your community in an attempt to at least forewarn them about prejudices that exist in the judical system.

I’m not trying to take credit for it, but when I heard the news about Genarlow’s release and saw it wasn’t on Bossip after a few minutes, I just sent them a message. A few minutes later they posted the story.
Maybe if you see something newsworthy and you bring it to their attention they will run it. Of course, first and foremost Bossip is an entertainment site.

It doesn’t state the girl’s race, but it gives what happened and some insight into why this young man was treated so harshly.
Here’s an excerpt:
Plea Deal Declined
Wilson chose not to plea bargain because first, he wasn’t guilty of either rape or molestation, and second, he did not want to spend his entire adult life on a registry of sexual offenders. He was the only teen involved whose case went to trial. The others succumbed to pressure from the DA’s office; most also had prior records. Wilson did not.
The small-town (Douglasville estimated population in 2005: 27,568) district attorney and prosecutor — Eddie Barker — made Wilson pay for the effrontery of insisting on his innocence. [Also, Douglasville is predominantly white; Wilson is black.]
Why do I say they “made him pay”? First, the DA’s office agreed that the young woman initiated the act. (So did she.) So why prosecute? Wilson was an honors student, had no tangles with the law, and there was no crime, ie, no one was harmed.
Nevertheless, McDade and Barker chose to prosecute the case. Moreover, as ESPN writes:
Barker is quick to point out that he offered Wilson a plea after he’d been found guilty — the first time he has ever done that. Of course, the plea was the same five years he’d offered before the trial — not taking into account the rape acquittal. Barker thinks five years is fair for receiving oral sex from a schoolmate. None of the other defendants insisted on a jury trial. Wilson did. He rolled the dice, and he lost. The others, he says, “took their medicine.”
This quote makes no sense to me. I don’t see how Barker could offer a plea post-conviction if the mandatory sentence is 10 years. Before trial, sure.
Atlanta Magazine quotes District Attorney McDade:
“We don’t believe that a 10-year sentence is an appropriate punishment [in this case], but he made that decision to put himself in that predicament,” explains McDade, of Genarlow’s refusal to cop a plea. “He has decided to become a martyr because people have been whispering in his ear, ‘We’ll make you famous like Marcus Dixon.’” …
McDade says he further supported the judge’s decision to treat Genarlow—the only one who had not had any run-ins with the law prior to this case—the same as the other [five] boys because he does not believe in offering First Offender status in sex crime cases.
I find the attitude reflected by the DA’s office to be small-minded, abhorrent and fully representative of too many middle-aged southern white men. (I know of what I speak: I am a middle-aged southern white woman, even if I no longer live in my native South.)
Consistency Is Not Douglas County’s Strong Suit
Atlanta Magazine points out the inconsistency when the Douglasville defendant is an adult white male:
But there are also other cases of adults—white adults—prosecuted by the Douglas County District Attorney’s office for sex crimes involving minors and received far lighter sentences than any of the teens in the Douglasville Six case.
Case in point: Jack Stewart, a 24-year-old volunteer coach at Heirway Christian Academy in Douglas County, who received 30 days in jail and 10 years probation for fondling the 15-year-old daughter of a couple whose house he was living at temporarily. McDade notes that he objected in court to the “inappropriately light” sentence.
In the case of 26-year-old George Tsimpides, First Offender status was extended in a sex crime. Tsimpides received 20 days in jail after he pleaded guilty to luring a 15-year-old girl he’d met on the Internet to Arbor Place Mall with the intention of engaging in sex with her. McDade says he publicly objected to that sentence.
One assumes these cases occurred before Georgia’s mandatory 10 year prison term; Atlanta Magazine does not say.
What You Can Do
If you know someone in Georgia, have them contact their legislators (Senate, House) and urge their support for Senate Bill 37 (bill text, summary). The bill would untie the hands of the courts.
You should also have them contact the Governor, although there is no possibility of parole.
Of course, you can do this too, even if you are not a Georgia resident, but having a constituent write or call or even e-mail is more effective.
Oh, and if you know of a PR firm that wants to do some pro bono work …

I think you are mixing this up with the Marcus Dixon case. Marcus been out of prison and attends Hampton University on scholarship. Appartently all those white schools that were scouting him didn’t want him after he spent nearly 2 years wasting away in prison.

The judge and the DA committed “prosecutorial misconduct”, which can be charged by the Georgia State Bar Association, and the Trial Judge Association, they can be fined and penalized.
I think that we as a people should each purchase some basic law material and start reading up, its going to keep happening everywhere.

As to the color of the victim…
If this girl was white her mama would have been all over tv crying this n***** done raped my girl, she would have milked the media for all it was worth.
If the girl was white, the DA would never have “advised” the woman to press charges, she would have had every major white organization behind her and believe me, the charges would have stood.
If the girl was white, why didn’t anyone protest the changing of the story, news officials were there.
The snippet of the camera phone that has gotten out does not show a white person in the clip they are black.
Making the victim be white does not change the fact that these people were intimidated, and the boy was unfairly charged, maybe it helps some people sleep better at nite knowing she was white, I don’t know but read between then lines.

He was charged because back in the day the law was to prevent teenagers from having oral sex. It was not about raping of anyone. It was to prevent anyone under 16 from giving or receiving oral pleasures. That is how he was able to be charged with RAPE… The girl giving the oral sex was indeed white, not black… WHY DO YOU THINK THEY MADE A BIG DEAL OF THIS???

Remember statutory rape laws are tricky. Some of them have a minimum age requirement so even if the law says the age of consent is 14 that is only if the other partner was within 3 years of the younger individual. Most people don’t realize that no where in the United Sates are two people under the age of consent allowed to have sex. So even 2 sixteen year olds can’t even have sex together if the age of consent is 18, but most people don’t press the issue unless the parents are pissed off or the DA is trying to make an example of someone. There was a case with a 13 year old girl who got pregnant by her 12 year old boyfriend and she was charged with statutory rape, but they later dropped the charges.

I’m sorry but he was 17 and she was 15. That’s not a huge age difference. I can understand if he was 17 and she was 12. But come on? And he went to prison at 17; that’s crazy and must have been a scary experience. I don’t want to make it about race, but let’s be real, it’s always about race. They took a 17 year old BOY and sentenced to jail for 10 years. If it was a Timmy that had done this; the case would have been dismissed or he would have gone to juvenile. Now, is that him in the pic, hate to say it but it looks like prison turned him ‘out.’ You can defintely see it in the pic, when I first saw the pic, I thought this story was about some gay dude.
That meakes me disgusted; I feel bad for him. You can tell prison changed him, he’s prbably gay now. And I;m being serious, just look at the pic. So sad. And at 17-21, he should have been enjoying his life. When you take a boy and put him in a population full of sharks; they will take advantage of that boy. That must have been terrifying experience for him. And this to me was an injustice, this case wall all about race baby. White girl. Black Boy. In the South. Do the math. I hope he can come blessed and stronger from this unfortunate event in his life.

I wish some of you would read up on Genarlow’s story, because it is obvious many of you know nothing about it. As much as I read on the case I still don’t know the race of the 15 and 17-year old girls. How do you know she is white? Secondly, the 15 year old gave head around the room to mulitple boys. She literally walked up to them and pulled their stuff out and put it in her mouth. This was not statutory rape unless you are charging the girl. The party was wrong from a parents standpoint, but it definately was not criminal.

During the sex act, she appears to be sleepy or intoxicated but never asks Wilson to stop. Later on in the tape, she is seen being pulled off the bed.
Other portions of the tape show a second girl, who was 15 and later said she did not drink that night. She was recorded having oral sex with several boys in succession, including Wilson.”
